Although it is regretable to critise any stud book keeping organisation, it is however necessary people are aware that the ASVH, ASRP and STD Societies still restrict imported licenced, Graded and Approved stallions with avelsvärdering in their rules. Avelsvärdering (stallion evaluation as a pre-requisite for admission to breed or not in Sweden) was ruled unlawful by the Commission, as it was seen as an obstacle to intra-Community trade. It was ordered to be abolished from Sweden in 2006.
SJV took the extroardinary and unprecedented stance to "misinterpret" the EU Court Ruling, so they could remove the "obligatory" from the State Legislation only and not the practice from Breed Societies and Organisations rules.
1. It was the practice and effects of avelsvärdering that were found unlawful. How is it then possible for SJV as the authority to allow an unlawful system to continue in any Society or organisations rules in Sweden?
2. Avelsvärdering was created by the Government and made law for a desired effect. By reverse, now it is unlawful, the Government must remove the system from the legislature so the practice and effects no longer continue.
SJV have been woefully negligent in upholding the intent of the EU Court Ruling, which was to bring Sweden in line with the rest of Europe and allow freedom to trade globally. We should all ask the question WHY?
Framtill nu, på grund utav lagen om obligatorisk avelsvärdering, har Sverige haft en väldigt begränsad tillgång till hingstar. Vi hade inte fördelen att kunna konkurrera internationellt, genom att använda internationellt erkända hingstar på den öppna marknaden. Nu kan även Sverige. All avkomma kan registreras i Sverige. Dock hävdar ASVH , att avelsvärdering inte är obligatoriskt enligt lag i Sverige samtidigt som man säger att det är obligatoriskt om man will erhålla "Green papers". Notera att alla hingstar som erbjuds här är redan graderade och godkända och behöver därför inte bli "återinspekterade" av ASVH. Efter att Sverige drogs inför EU-domstolen i Luxenburg rörande avelsvärdering, beordrades Sverige att ändra sin lagstiftning. Hingstar som redan är godkända i ett annat EU-land behöver inte "återvärderas" i Sverige. Därför måste ASVH utfärda "Green Papers" till avkomma med berättigad stamtavla.
